2. Definitions
- Customer / You: The person or business placing an order.
- Consumer: A private individual purchasing outside business activity.
- Business Customer: A legal entity or individual acting in a business capacity.
- Product: Any physical product sold via the Website.
- Agreement: The binding contract formed upon order confirmation.
3. Scope and Applicability
These Terms apply to all sales unless otherwise agreed in writing.
Mandatory consumer rights under Norwegian law always prevail over these Terms.
4. Order and Contract Formation
An Agreement is formed when you receive an order confirmation by email.
We reserve the right to cancel or correct orders due to stock issues, pricing errors, or technical mistakes.
5. Prices and Taxes
- Prices are shown in NOK include VAT and EUR exclude VAT, clearly stated at checkout.
- Shipping costs are calculated and shown before payment.
- Promotional offers may have separate conditions.
6. Payment
Accepted payment methods: Visa / Mastercard / Klarna / American Express/ PayPal
Payment is normally captured when the order is shipped (or earlier if stated).
7. Delivery and Shipping
- Delivery area: Norway / International
- Estimated delivery time: 2-7 business days (subject to availability and carrier delays)
Risk transfer:
- Consumers: Risk passes upon physical receipt of the Product.
- Business customers: Risk passes when handed over to the carrier, unless otherwise agreed.
Transport damage must be reported without undue delay.
8. Right of Withdrawal (Consumers only)
Consumers have a 14-day right of withdrawal from the day the Product is received, in accordance with the Norwegian Right of Withdrawal Act.
- You must notify us clearly before the deadline.
- Return shipping costs are normally borne by the customer.
- Refunds are issued within 14 days after return or proof of return.
Exceptions apply for custom-made or hygiene-sealed products, as permitted by law.
9. Returns (Voluntary Policy)
In addition to statutory rights, we may offer a voluntary return policy:
- Return period: 30 days
- Condition: Unused, undamaged, original packaging
This does not limit your legal rights.
10. Complaints and Defects
Consumers may complain about defective Products within a reasonable time.
Statutory complaint period is:
- 2 years, or
- 5 years if the Product is intended to last significantly longer.
Valid complaints may entitle you to repair, replacement, price reduction, or refund, in accordance with Norwegian law.
11. Product Use and Safety
Some Products may be safety-critical and require correct installation, maintenance, and use according to manuals and instructions.
SmartGroup is not liable for damage caused by:
- Incorrect installation or misuse
- Unauthorized modifications
- Use contrary to provided instructions
12. Liability and Limitations
Nothing in these Terms limits mandatory consumer rights.
For business customers, SmartGroup is not liable for indirect or consequential losses, unless required by mandatory law.
13. Force Majeure
We are not liable for delays or failure caused by events beyond our reasonable control, including strikes, pandemics, supply chain disruptions, or government actions.
14. Intellectual Property
All content on the Website (text, images, manuals, trademarks) is owned by SmartGroup AS or its licensors and may not be used without written permission.
15. Privacy and Cookies
We process personal data to fulfill orders, provide support, and comply with legal obligations.

16. Changes to Terms

The version in force at the time of order applies to that purchase.
17. Governing Law and Disputes
These Terms are governed by Norwegian law.
Consumers may contact the Norwegian Consumer Council (Forbrukerrådet).
Business disputes shall be settled by Norwegian courts, with venue in Oslo District Cour,, unless otherwise required by law.
